Bee Experience – Liability Waiver & Release
ONE WAIVER · COVERS ALL BEE EXPERIENCESBy signing below, I acknowledge and agree to the following on behalf of myself AND any child(ren) listed, with respect to whichever experience(s) I selected above:
- Nature of Activity. I am voluntarily participating (and allowing my child(ren) to participate) in a Bee Experience operated by Mike & Niki's Honey Company ("MNHCo"), which depending on the option(s) selected may include: (A) an Onsite Lecture / Observation – observing live colonies from a safe distance, a teaching hive, and a honey tasting, with no bee handling; and/or (B) a Full Suited Hands-On Experience – wearing protective equipment, entering an active bee yard, and handling live frames of honey bees in direct proximity to open colonies.
- Inherent Risks. Risks include but are not limited to: bee stings (possible while observing and LIKELY while handling live bees), multiple stings, stings through or around protective equipment, allergic reactions including anaphylaxis, allergic reaction to honey or bee products during tasting, slips, trips, falls on uneven terrain, heat-related illness from protective suits, and contact with beekeeping equipment. These risks cannot be fully eliminated regardless of precautions taken.
- Assumption of Risk. I voluntarily assume all risks of injury, illness, or death – for myself and any child(ren) listed – whether caused by the negligence of any of the Released Parties (named in Paragraph 4) or otherwise.
- Release, Hold Harmless & Indemnify. I, on behalf of myself, any child(ren) listed, and our heirs, executors, and assigns, hereby release, hold harmless, indemnify, waive, and forever discharge the following (the "Released Parties"): (a) Mike & Niki's Honey Company, its owners Michael and Thessaloniki Canotas, and its employees, agents, representatives, and volunteers; (b) the City of Sunnyvale, including its Mayor, City Council members, officers, directors, employees, agents, and volunteers; (c) the Sunnyvale Community Center, including its Director, employees, and agents; (d) the City of Mountain View, including its elected officials, officers, employees, and agents; and (e) Olson's Cherries / Olson's Orchards, including its owners, employees, agents, and volunteers – from any and all claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death sustained during or as a result of participation in any experience selected above, whether caused by the negligence of any Released Party or otherwise.
- Protective Equipment (Suited Experience). If I selected the Full Suited Hands-On Experience, I agree (and will ensure my child(ren) agree) to wear the provided bee suit, gloves, veil, and any additional protective equipment as directed by MNHCo staff at all times in the bee yard. Removing or improperly wearing equipment is at the participant's own risk and may result in stings.
- Medical Authorization & 911. I authorize MNHCo to call 911 and/or secure emergency medical treatment for me and any child listed if needed. MNHCo staff are not medical providers. I am responsible for all costs of emergency medical treatment.
- Rules & Instructions. I agree to follow all safety instructions from MNHCo staff, including maintaining a safe distance from hives, moving slowly, not swatting at bees, keeping protective equipment on, and following the beekeeper's directions. MNHCo may remove any participant who does not follow safety guidelines, without refund.
- Parental Responsibility. If I have listed child(ren), I am their parent or legal guardian with authority to sign on their behalf, I will supervise them, and I accept full responsibility for their actions and safety.
- Weather Cancellation. Experiences may be cancelled or rescheduled due to weather or bee behavior. Rescheduling is at no additional cost.
- California Law & Severability. Governed by the laws of the State of California; disputes resolved in Santa Clara County. If any provision is unenforceable, the rest remain in full force.
